Terms of Service

1. Acceptance of Terms

By accessing or using AestheticIQ ("Service"), operated by ServiceVision ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including medspa owners, managers, and staff who access the Service under an account.

2. Description of Service

AestheticIQ is a business analytics platform designed for medspa operators. The Service connects to your Aesthetic Record (AR) account via authorized API access to retrieve financial and operational data, generates AI-powered insights, and presents analytics through a web dashboard. The Service does not modify, delete, or transmit data back to Aesthetic Record.

3. Account Registration & Security

To use the Service you must create an account and provide accurate information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access at support@aestheticiq.ai
  • Ensuring that all users added to your account comply with these Terms

We use Clerk for authentication and industry-standard encryption for stored credentials. You must not share your login credentials with individuals outside your organization.

4. Authorized Use of Aesthetic Record Data

By connecting your Aesthetic Record account, you authorize AestheticIQ to access your business data solely for the purpose of providing analytics services to you. You represent that you are authorized to grant this access and that your use of AR data through our Service complies with your agreement with Aesthetic Record. We store your AR credentials encrypted at rest using AES-256-GCM and never transmit them to third parties.

5. Subscription & Payment

Access to the Service requires a paid subscription. By subscribing:

  • You authorize us to charge your payment method on a recurring basis at the rate of your selected plan
  • Subscriptions renew automatically unless canceled before the renewal date
  • Refunds are not issued for partial billing periods
  • We reserve the right to change pricing with 30 days written notice
  • Payments are processed by Stripe; we do not store payment card information

If your payment fails, we will notify you by email and provide a grace period of 7 days before suspending access. You may manage your subscription at any time from Settings → Billing.

6. Data Ownership & Privacy

You retain ownership of all business data you provide or that is retrieved from your AR account. We process your data solely to provide and improve the Service. We do not sell your data to third parties. For full details on how we collect and use data, please review our Privacy Policy.

7. AI-Generated Content

The Service uses AI to generate business insights, recommendations, and summaries based on your data. AI-generated content is provided for informational purposes only and does not constitute financial, medical, or legal advice. You are solely responsible for business decisions made based on information provided by the Service. AI outputs may contain errors; always verify critical figures against your source systems.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use automated tools to scrape or extract data from the Service at scale
  • Share your account access with unauthorized third parties
  • Interfere with or disrupt the integrity or performance of the Service

9. Intellectual Property

The Service, including its software, design, and content (excluding your business data), is the intellectual property of ServiceVision and is protected by applicable copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes during the term of your subscription.

10. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICEVISION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

Either party may terminate the Service relationship at any time. You may cancel your subscription through Settings → Billing. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your access to the Service will cease. We will retain your data for 30 days following termination, after which it may be permanently deleted. You may request an export of your data before termination by contacting support@aestheticiq.ai.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service at least 14 days before the changes take effect. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Missouri.
